Terms of Use

These general terms and conditions of sale (hereinafter referred to as “GTC”) are valid for all purchases made on the website volzak.com (hereinafter referred to as the “Site”).

PURPOSE AND SCOPE OF APPLICATION

The purpose of the General Terms and Conditions of Sale is, on the one hand, to inform any potential person visiting the Site in order to place an order (hereinafter referred to as the "Buyer") of the terms and conditions under which the seller, VOLZAK, proceeds with the sale and delivery of the products ordered and, on the other hand, to define the rights and obligations of the parties in the context of the sale of products by VOLZAK.

Any order for products implies the Buyer's unreserved acceptance and full adherence to the General Terms and Conditions. Under no circumstances may VOLZAK's failure to exercise a right be considered a waiver of that right.

VOLZAK reserves the right to modify the General Terms and Conditions at any time and without notice. The order will be subject to the General Terms and Conditions in effect at the time the order is placed.

The Buyer, prior to placing an order, declares:

that he has full legal capacity allowing him, by himself or through his legal representative, to place an order on the Site. VOLZAK cannot be held under any circumstances responsible for verifying the legal capacity of its Buyers. Consequently, if a Buyer does not have the legal capacity, his legal representatives will assume full responsibility for any order on the Site and must in particular honor the price;
accept and respect the T&Cs;
not to order products for the purpose of reselling them; and that the ordering of products on the Site is not directly related to its professional activity and is strictly limited to personal use.

FORMATION OF CONTRACT AND ORDERS

2.1 PRICE

The prices of the products offered for sale online on the Site, indicated in dirhams, are those in effect at the time the Buyer places the order. VOLZAK may modify the sales prices at any time. This modification will be notified to the Buyer before any order is placed.

These prices do not include shipping/delivery/transportation costs, which are charged in addition to the price of the products purchased, and more generally any other specific costs indicated during order validation. Shipping costs will be indicated during confirmation according to the Buyer's delivery city. The various shipping methods are provided below in the General Terms and Conditions and may be modified at any time by VOLZAK. VOLZAK therefore advises all Buyers to regularly consult the General Terms and Conditions appearing on the Site.

Prices include value added tax (hereinafter referred to as “VAT”) applicable on the day of the order. Any change in the applicable VAT rate will be automatically reflected in the price of the products sold by VOLZAK on the Site.

2.2 PRODUCT CHARACTERISTICS AND AVAILABILITY

The Buyer can select one or more products from the different categories offered on the Site.

The offers presented by VOLZAK are valid as long as they are advertised on the Site, and within the limits of available stocks.

VOLZAK may modify the assortment of products offered for sale on the Site at any time, in particular depending on constraints related to its suppliers, without prejudice to orders placed by the Buyer. Information on product availability is provided to the Buyer at the time of placing their order. Any product that is out of stock will not be valid for order validation.

In accordance with the Consumer Code, the Buyer may, prior to placing an order, find out on the Site the essential characteristics of the product(s) he wishes to order.

2.3 ORDER

To place an order, the Buyer can create a customer account, or browse as a guest on the Site.

To create a customer account, the Buyer must complete all fields marked with an asterisk, including:

FIRST NAME
EMAIL ADDRESS
PASSWORD

To validate their customer account, the Buyer must register and confirm a password. This password is strictly confidential.

In addition to this information when the customer account is created, the Buyer must, in order to place their order, provide the following information:

The postal address (one for the delivery address and one for the billing address if this is not the same as the delivery address)
A phone number

The Buyer guarantees the sincerity and veracity of the information provided and releases VOLZAK from any liability due to the inaccuracy of the information provided. The Buyer will have access to their customer information in their dedicated space. The Buyer has the possibility to check the details of their proposed order and correct any errors until their order is confirmed.

From the moment the Buyer confirms his order by clicking on the "Order" button during the order process and, after having checked the contents of the order in his basket, the Buyer will definitively validate the sale by payment and will be considered to have knowingly accepted the content and conditions of the order in question. More specifically, the Buyer will be deemed to have accepted the current General Terms and Conditions, the prices, volumes, characteristics, quantities and delivery times of the products offered for sale and ordered by him.

This order will be confirmed by sending an email to the Buyer. The Buyer is informed that this email will be sent to the email address entered by the Buyer when placing the order. VOLZAK recommends that the Buyer keep this email on paper or electronically.

When the reason is legitimate, in particular the cases usually accepted by case law and as detailed below, VOLZAK reserves the right to cancel or refuse any order from a Buyer, without such cancellation or refusal being able to lead to the payment of any damages and/or costs other than the reimbursement of any amount paid by the Buyer in respect of said order:

Buyer's billing and/or shipping information is incorrect or unverifiable;
A dispute relating to a previous order exists with the Buyer;
The order includes one or more unavailable products; or

The order made by the Buyer is recognized as an unusual order, susceptible to fraud or made by a reseller.

PAYMENT

3.1 PAYMENT TERMS

The payment methods accepted to date are: COD (Payment on Delivery) and Bank Card in Morocco; Paypal and Bank Card internationally.

Any bank charges remain the responsibility of the Buyer, including in the event of a refund. The Buyer declares that they are fully authorized to use the payment card provided to finance their order.

3.2. SECURITY OF PAYMENT OPERATIONS

VOLZAK is committed to using the most efficient and secure encrypted transmission and payment methods available today. No payment information is stored.

3.3. PAYMENT INCIDENTS

VOLZAK reserves the right to suspend or cancel any order execution and/or delivery, regardless of its nature and level of execution, in the event of non-payment or partial payment of any amount due by the Buyer, in the event of a payment incident, in the event of fraud or attempted fraud, including in the event of subsequent orders.

DELIVERY

Volzak.ma delivers to Morocco, and also internationally.

The Buyer is hereby reminded that delivery costs as well as customs fees for international shipments are their responsibility. In addition, a fee of 40 dirhams will be charged for the delivery of orders under 900 dirhams in Morocco. For international shipments, fees are determined by destination and weight.

The ordered products will be sent, along with the delivery slip, to the delivery address indicated by the Buyer during the ordering process. All orders received will be processed from Monday to Friday. Delivery times are effective from the time the package is taken over by our service providers (Amana and Cathedis for Morocco; DHL for international). All deliveries are announced by email.

In the event of absence upon delivery, at the address indicated by the Buyer, it is possible to collect the package from a Post Office or Relay Point within fifteen (15) days following deposit.

If the Buyer fails to collect their order or if they provide incorrect information when confirming their order, it will be returned to VOLZAK.

VOLZAK undertakes to indicate delivery times (in working days) and costs depending on the region: 24 to 72 hours in Morocco and 48 to 5 days internationally.

VOLZAK strives to meet the delivery times it indicates upon acceptance of the order, based on the reference logistics time in the profession, and to execute orders, except in cases of force majeure, or in the event of circumstances beyond its control. In particular, cases usually recognized by case law will be considered as cases of force majeure.

Each delivery is deemed to have been made upon the product being made available to the Buyer by the postal service or the carrier. It is the Buyer's responsibility to check the shipments upon arrival and to make any reservations and complaints (e.g. damaged package) that appear justified within the mandatory period of fourteen (14) calendar days from delivery, failing which the Buyer will be barred.

The Buyer will have the choice between delivery and collection of their package from the VOLZAK store.

As soon as their order is available, the Buyer receives a notification informing them that their order can be collected from the store.

The Buyer then has three (3) days to collect their package. If the package is not collected within this period, VOLZAK will cancel the order.

BACK

6.1 RETURN OF PRODUCTS

The Buyer must return the product(s) concerned (hereinafter the "Return"), without undue delay and, in any event, within a maximum period of fourteen (14) calendar days from the date of exercising his right of withdrawal, without having to provide reasons. However, VOLZAK accepts that the Buyer may make the Return up to a maximum period of fourteen (14) calendar days from the day of receipt of the package containing the products ordered by himself or by the recipient of the order.

The Buyer must return the product by affixing the label, available in the " Returns " section, to the package. The package must contain the product(s) indicated when exercising the right of withdrawal, as well as the delivery slip.

The Buyer must return the product in its original box, unworn or undamaged. Any product that is returned, in particular incomplete, damaged, worn, soiled or not allowing its return to the market in new condition, cannot be refunded to the Buyer if the depreciation of the product results from handling other than that necessary to establish the nature, characteristics and proper functioning of this product.

6.2 RETURN REFUND

VOLZAK undertakes to reimburse the Buyer for all sums paid, including delivery costs, without undue delay and after verification of the Return, within fourteen (14) days from the date of withdrawal by the Buyer. VOLZAK does not reimburse the Buyer for delivery costs, expressly chosen by the latter, which would be more expensive than the standard delivery method proposed when ordering.

Refunds are made to the Buyer using the payment method used when ordering:

Credit card payment: The transfer is made to the bank account used to pay for the order.
Payment on delivery: a bank account number must be determined to make the transfer.

RETURN TO STORE:

The Buyer may exchange the product(s) ordered on the Site free of charge in any VOLZAK store. Any products not meeting the conditions of the last paragraph of Article 6.1 of the General Terms and Conditions will not be payable upon return to the store.

The Buyer has a period of fourteen (14) calendar days to exchange their products from the date of receipt of their order.

In-store exchanges will only be accepted upon presentation of the delivery slip included in the package.

The Buyer may exchange their products only depending on the stocks available in store.

In the case of an exchange with one or more products whose total amount is higher than the price of the exchanged product, the Buyer will have to pay the difference between the two amounts. Otherwise, the Buyer will receive a credit equal to the price difference between the returned product(s) and the new product or will be refunded in store.

INTELLECTUAL PROPERTY

All texts, comments, works, illustrations and images reproduced on the Site as well as the associated pages (in particular blogs, social networks) are the exclusive property of VOLZAK, the sole holder of intellectual property rights on these documents. Any total or partial reproduction of the Site is strictly prohibited without the prior agreement of VOLZAK.

The brands distributed by VOLZAK are registered trademarks. The reproduction, imitation, use, positioning, deletion, or modification of a registered trademark constitutes an act of counterfeiting punishable by law.

RESPONSIBILITY

VOLZAK has an obligation of means for all stages of order taking as well as for stages subsequent to the conclusion of the sales contract. VOLZAK undertakes to describe the products sold on the Site with the greatest accuracy and more precisely through the product sheet.

VOLZAK shall not be held liable for the obligations of the General Terms and Conditions of Sale in the event that the failure to perform its obligations is attributable to the actions of a third party, even if foreseeable, to the fault of the Buyer or to the occurrence of a force majeure event, as described in Article 4 of the General Terms and Conditions of Sale.
VOLZAK cannot be held liable for any inconvenience or damage inherent in the use of the Internet network, particularly in the event of service interruption, external intrusion, the presence of a computer virus, or any event deemed to be force majeure.

In such circumstances, VOLZAK will have an additional period of time to fulfill its obligations, without any compensation being claimed from it.

SIGNATURE AND PROOF

The use of the Buyer's username and/or password, the provision of the bank card number and the final validation of the order will constitute proof of his identity, the payment of the order and the corresponding amounts.

VOLZAK cannot, under any circumstances, be held responsible for the fraudulent use of this information, it being recalled that it is the Buyer's responsibility to maintain the security of their online transactions, for example by not communicating their username and/or password.

PERSONAL DATA & COOKIES

When you place your order, the personal data collected will be subject to computer processing. You are invited to refer to the " Personal Data" tab. " of the Site to obtain information relating to this subject.

APPLICABLE LAW AND LAW

The General Terms and Conditions are subject to Moroccan law, subject to the mandatory rules of the Buyer's country of residence.

In the event of a dispute, an amicable solution will be sought as a priority over any legal action. To do this, the Buyer may first contact VOLZAK customer service at the following address:

If no amicable solution is found directly with VOLZAK, the Buyer is informed of the possibility of initiating, at their choice, an alternative dispute resolution procedure or a procedure before the competent Court, in the event of a dispute, the Court of Casablanca, Morocco.
